Welcome to Max Power Microgreens, operated by Eastside Microfarms, LLC (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of maxpowermicrogreens.com and any related products or services (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. Eligibility & Account Responsibility

You must be at least the age of majority in your state of residence to use our Services.

You agree to provide accurate, current, and complete information when placing an order or managing an account. You are responsible for maintaining the security of your account credentials and for all activity under your account.

2. Our Products

Our products are fresh, perishable, and harvested to order.

We make every effort to accurately represent our products; however:

  • Appearance may vary due to natural growing conditions

  • Colors and sizes may differ slightly from images shown

Product availability, descriptions, and quantities are subject to change without notice. We reserve the right to limit or discontinue products at our discretion.

3. Orders & Acceptance

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason.

Orders are not considered accepted until payment is processed and confirmation is issued. Due to the perishable nature of our products, orders may not be modified or canceled once they have entered the harvest or delivery schedule.

Refunds or replacements are governed solely by our Quality & Refund Policy.

4. Subscriptions

Some products are offered as subscriptions with recurring deliveries on set delivery days.

Subscription changes, skips, pauses, or cancellations require at least 10 days’ advance notice before the next scheduled delivery. Once an order is scheduled for harvest, it cannot be changed or canceled.

5. Pricing & Payment

Prices are subject to change without notice and are confirmed at checkout. Prices do not include applicable taxes or delivery fees unless stated otherwise.

You agree to provide valid payment information and authorize us to charge the payment method provided for all purchases.

6. Delivery & Pickup

We offer local delivery on set delivery days within the Greater Seattle Area. Delivery timing is not guaranteed and may vary by route.

Local pickup may be available by arrangement. Risk of loss transfers to you upon delivery or pickup.

7. Intellectual Property

All content on the Services — including text, images, logos, designs, and trademarks — is owned by Max Power Microgreens or its licensors and is protected by intellectual property laws.

You may not reproduce, distribute, or use any content without our prior written consent.

8. Third-Party Tools & Links

Our Services may include links to third-party websites or tools. We are not responsible for their content, policies, or practices. Use of third-party services is at your own risk.

9. Relationship with Shopify

Max Power Microgreens is powered by Shopify. However, all sales are made directly between you and Max Power Microgreens.

You agree that Shopify is not responsible for any aspect of your purchase or use of our products and services.

10. Privacy

Your use of the Services is subject to our Privacy Policy, which describes how we collect and use personal information.

11. Feedback & Reviews

If you submit reviews, comments, or other feedback, you grant us the right to use that content for business and promotional purposes without compensation.

You are responsible for ensuring that any feedback you submit is lawful and accurate.

12. SMS Messaging

By texting the keyword HELLO or HELO to Max Power Microgreens, you consent to receive SMS text messages from us related to your use of our services. These may include, but are not limited to, appointment reminders, service notifications, account updates, or other information you request.

  • Message Frequency & Costs
    Message frequency may vary. Standard message and data rates from your carrier may apply. 
  • Opt-Out

  • Data Use & Privacy
    We do not sell or share your mobile phone number with third parties for their independent marketing purposes. We may share your information with trusted service providers who assist us in delivering our services, and those providers are contractually prohibited from using your information for their own marketing. 13. Prohibited Uses

You may not use the Services for unlawful, abusive, fraudulent, or harmful purposes, or in a way that interferes with the operation or security of the Services.

We reserve the right to suspend or terminate access for violations of these Terms.

Our Services and products are provided “as is” and “as available.” Except as expressly stated, we make no warranties of any kind, express or implied.
